Private costumers may cancel the order/contract within 2 (two) weeks starting with the receipt of the goods in writing (letter, e-mail, fax) or by returning the delivery to rotWEISSrot without any reason. The cancellation has to be addresses to: vinothek rotWEISSrot, Dornbergstr. 11a, 81673 Munich, Germany, by e-mail to info@rotweissrot.de or by fax to +49 (89) 43569922.
With a cancellation, you shall take reasonable care of the goods when returning them to rotWEISSrot at your own expense, so there is no damage during shipment. The goods have to be returned at buyer's expense. Upon cancellation and receipt of the returned goods, rotWEISSrot will refund the invoiced prices of the returned goods in original condition including VAT and refundable customs duties within 30 (thirty) days of the receipt of the cancellation notice. Goods not in original condition (e.g. damaged, partially used) will be refunded in proportion to the condition. International shipping costs, fees and non-refundable customs duties will not be refunded.
In addition, customers in Germany have a "Widerrufsrecht" according to the "Consumer Protection (Distance Selling) Regulations 2000". Please refer to the Allgemeine Geschäftsbedingungen (in German) for Details.

Scope
Our terms and conditions apply to all purchases at and deliveries from rotWEISSrot in the present version.
Pricing, Tax and Customs
All prices are stated in Euro including German value-added tax (VAT), usually per 0,75l bottle of Wine. Listing of products in our online shop does not constitute a binding offer to sell, but an invitation to place an offer to buy, subject to prior sale either online or in our store. Available quantities and prices are confirmed only by receipt of the goods and/or invoice.
For deliveries outside of the European Union, the German VAT will be credited and the destination country's VAT will be charged (billing and shipping address outside of the EU required) as well as applicable customs duties and fees will be charged (shipping address outside of the EU) in our online shop directly in the ordering process. No additional customs clearance and application for VAT refund is necessary/possible.
For deliveries outside of Germany, Customs duties, VAT and shipping cost are calculated in our online shop as accurately as possible. Should any assumption or calculation emerge as wrong after ordering, rotWEISSrot reserves the right to correct the calculation.
Conclusion of Purchase Contract
Clicking the submit order now-button constitutes your offer to purchase goods as ordered. You will immediately receive a confirmation of receipt by e-mail after submitting the order which does not represent a formal order confirmation and thus an acceptance of your offer to purchase. The purchase contract is only concluded by our formal order confirmation or delivery of the goods. The purchase contract will be concluded with rotWEISSrot, Inh. Gerhard Biber, Dornbergstr. 11, 81673 Munich, Germany in German or English language.
Protection of Minors
We only conclude contracts with customer of 18 years and older. With submission of your order you confirm to be 18 years or older the accuracy of the submitted data regarding age, name and address are correct. Furthermore you confirm that the shipment will be accepted by yourself or your appointed agent and take reasonable care to prevent abuse by minors. We reserve the right to request a proof of age before shipping any alcoholic beverages, our forwarders are obligated to ensure the appropriate age of the recipient.
Shipping and Shipping Costs
Orders will be delivered using UPS - or alternatively DHL on specific request - usually within three working days. Longer delivery time due to availability is indicated in our online shop during the ordering process. Packing and shipping cost is depending on order size and destinatin country, exact shipping costs are displayed in our online shop and listed in the shipping cost overview.
Payment
Payment for goods ordered is due net immediately and payable by advance payment, credit card, PayPal, cash-on-delivery (COD), direct debit (Germany only), invoice/wire transfer (Select customers from Germany and Austria only). Additional fees apply, please refer to the overview of payment methods. In case an order paid by advance payment can not be accepted (e.g. ordered wines have become unavailable), we will return the payment immediately.
Retention of Title
All delivered goods remain property of rotWEISSrot until full payment has been irrevocably received.
Guaranteed Quality
Our wines have been carefully selected and are procured exclusively from renowned quality producers. In case a wine shows severe deficiencies (e.g. cork issue), we will credit the amount or replace any affected bottle after it has been returned.
Partial and Replacement Deliveries
Orders are usually delivered in a single shipment. We reserve the right to ship any order in multiple shipments if required (e.g. insufficient stock) without charging any additional shipping cost.
In case of limited stock, we will ship the quantity available. For wines below € 15,- we will complete orders with successive vintages if available and comparable in type, price and quality.
Damage during Transport
In case of apparent damage during transport (glass shards, soaked packing) please have the deliverer document the damage or -in case of obvious total damage- refuse acceptance of the shipment and have the package returned to us. All shipments are insured and any damage will be reimbursed or replaced after return of the damaged goods.
Recycling of Packing Material
Packing Material used for sale and shipping is fully recycable and registered in die Dual System. Please recycle cardboard packing and waste glass at your local recycling facility or send it back to us.
Jurisdiction
The parties hereby expressly agree on jurisdiction of the commercial court of Munich, Germany.
Severability Clause
Should any individual provision of the contract or our terms and conditions become invalid for any reason, all other provisions shall not be affected and remain in effect. The invalid provision shall be replaced by the corresponding valid provision of German Law.
